Terms of Service: Point of Sale

By purchasing, I agree to the Terms of Service for the money strong programs (MS Programs).

By purchasing any of the following one-time products or services from Money Strong Group (Money Strong Pty Ltd (ABN 92 685 451 361) and Thalia Stanley Group Pty Ltd (ABN 12 624 957 857)), you ("Client" or "You") agree to the following Terms of Service ("Terms"):

  • Online Courses: 'Foundations by Money Strong' and 'Honourable Custodian of Money'
  • Services: 'Private Mentoring' (Purchased as a single or fixed bundle)

1. Service Description
Money Strong Pty Ltd provides financial education and literacy training and private mentoring services through online, self-paced courses, in conjunction with private one-on-one mentoring.

What you purchase grants a defined period of access to digital course content and/or a fixed bundle of scheduled mentoring sessions as specified in the description at the time of purchase. Extra mentoring sessions beyond what is included in your program, can be purchased as both a one off session or a bundle.

2. Access and Delivery

  • Delivery: Upon purchase, you will receive instructions, typically via email, on how to access the online course platform and how to schedule your mandatory Onboarding Session to commence the course or mentoring.
  • Client Responsibility: You are responsible for maintaining the security of your login credentials and for accessing the course content promptly.

3. Payment and Billing

  • Purchase Structure: All course and mentoring bundles are one-time purchases for a fixed term and do not involve automatic renewal.
  • Currency: The Service is billed in Australian Dollars (AUD) and includes GST.
  • Payment Gateway: All payments are processed using the payment gateway provided by Stripe.

4. Intellectual Property (IP)

  • All course materials, including but not limited to videos, workbooks, guides, text, graphics, and mentoring content ("Course Materials"), are the exclusive property of Money Strong Pty Ltd and are protected by copyright. The use of ‘money strong’ is also a trademarked brand.
  • License Grant: your purchase grants you a single, non-exclusive, non-transferable license to use the money strong course materials for your own personal, non-commercial purposes only.

5. Refund Policy (Australian Consumer Law Compliance)

5.1. Change-of-Mind Refund Window
We offer a voluntary change-of-mind refund, provided:

  1. The refund request is received within 7 days in writing from the date of purchase, AND
  2. The Client has not yet attended the Onboarding Session or commenced the program.
  3. Activation Clause: Once the Onboarding Session has been attended, the Service is considered delivered and activated, and you are no longer eligible for a change-of-mind refund.

5.2. Circumstances Not Warranting a Refund
No refund will be issued based on non-completion of the course or mentoring sessions (e.g., changing your mind, not making time to complete the course as intended).

5.3. Statutory Consumer Guarantees
Your rights under this policy are in addition to your rights and remedies under the Australian Consumer Law (ACL), which cannot be excluded.

6. Data and Privacy

  • Data Handling: Money Strong Pty Ltd takes reasonable steps to ensure your personal data is handled securely in compliance with Australian privacy laws.
  • Privacy Policy: Please refer to the separate Money Strong Privacy Policy for comprehensive details.

7. Termination

  • Access Expiry: Access to the online course materials will automatically cease at the end of the fixed-term access period specified at the time of purchase.
  • Client Cancellation: You may request that your access be terminated sooner by contacting us in writing.

8. No Guarantee of financial or other outcomes
Money Strong Pty Ltd provides education, information, and guidance, but does not provide financial advice, investment advice, nor tax advice.

  • No Guarantee of Results: We cannot and do not guarantee any specific financial outcome, revenue increase, or specific result from the use of our MS courses, mentoring, or materials.
  • Client Risk and Responsibility: You acknowledge that your ultimate success or failure is the result of your own independent efforts and financial decisions, which are beyond the control of Money Strong Pty Ltd.
  • ACL Compliance: This clause does not exclude or modify any rights or remedies you may have under the Australian Consumer Law (ACL) regarding the quality of the service provided.

9. Links to Other Websites

  • External Links: The course materials or website may contain links to other websites not operated by Money Strong Pty Ltd. Money strong cannot guarantee these links remain current or in any way represent those businesses. Neither is there any representation that the links are secure.

10. Security of Electronic Devices
Money Strong Pty Ltd does not accept responsibility for any loss or damage to your computer systems, mobile phones, or other electronic devices arising in connection with the use of the Website or Course platform.

11. Reporting Misuse and Errors
If you become aware of any misuse, errors, or difficulty in accessing the platform, please contact us immediately via [email protected] or the contact form on our Website.

12.  Dispute Handling and Resolution

12.1. Raising a Dispute
If you have a concern, complaint, or dispute regarding the Service (excluding refund claims already covered in Section 9), you must first submit a formal written notice to us.

  • How to Raise: Send a detailed email outlining the nature of the dispute, the relevant dates, and the desired resolution to [email protected].

12.2. Resolution Process

  • Mandatory Good Faith Negotiation: Both parties agree to use their best efforts to resolve the dispute through good faith negotiation within 14 days of the written notice being received.
  • Failure to Resolve: If the dispute cannot be resolved through negotiation within the 14-day period, either party may then pursue other available legal or consumer protection remedies, including contacting relevant Australian consumer affairs bodies.

12.3. Governing Law
These Terms are governed by the laws of the State of Victoria, Australia.
